Policy Statement and Order
The Commodity Futures Trading Commission adopted the Policy Statement Concerning the Listing of Perpetual Contracts on May 29, 2026. The statement appeared in the Federal Register on June 3 under 91 FR 33160 and FR Doc 2026-11020. On the same date the Commission issued an order approving the KalshiEX LLC BTCPERP futures contract that references the spot price of bitcoin. The document is a policy statement and a single contract approval rather than a final rule.
Perpetual contracts carry no fixed expiration date. A periodic funding-rate exchange between long and short positions replaces the usual convergence at expiry. The Commission directed that Regulation 40.3 voluntary prior approval applies for most new perpetual contracts because the cash-settlement reference must remain reliable at every funding interval under DCM Core Principle 3. Asset classes singled out for case-by-case review include agricultural products, precious metals, equity securities, and narrow-based security indexes. Agricultural perpetuals drew particular caution.

Chairman Selig voted in favor. No commissioner recorded a negative vote. The policy is framed as a general statement under 5 U.S.C. 553(b)(A) and does not change the Commodity Exchange Act itself. Earlier steps included a staff request for comment issued April 21, 2025 and a Presidential Working Group report dated July 30, 2025.
